Delta 8 THC has gained popularity for its mild psychoactive effects, but when it comes to air travel, things can get a bit complicated. If you’re wondering whether you can bring Delta 8 on a plane, here’s what you need to know.
Is Delta 8 Legal for Air Travel?
Delta 8 is derived from hemp and is federally legal under the 2018 Farm Bill, as long as it contains less than 0.3% Delta 9 THC. However, state laws vary. Some states have banned Delta 8, so carrying it through certain airports or destinations could be risky.
TSA’s Policy on Delta 8
The Transportation Security Administration (TSA) is focused on security threats, not cannabis products. However, if TSA officers find a substance that appears illegal, they may refer it to local law enforcement. Since some states ban Delta 8, carrying it could lead to legal issues, depending on where you’re flying from or to.
Flying Domestically vs. Internationally
- Domestic Flights: If you’re flying within the U.S., check the laws of both your departure and arrival states. Some states, like Texas and Florida, allow Delta 8, while others, like Colorado and New York, do not.
- International Flights: Many countries have strict cannabis laws, and Delta 8 could be classified as an illegal substance. It’s best to avoid flying internationally with it.
How to Travel Safely with Delta 8
- Check the laws of your departure and destination states.
- Keep Delta 8 products in their original packaging.
- Opt for edibles or tinctures instead of vape carts, as TSA is more likely to inspect vape products.
- Avoid bringing large quantities to minimize suspicion.
